OB3 Privacy Policy

 

 

This Privacy Policy applies to OceanBrowser Limited’s (We, Us, Our) OB3 website and platform (the Platform) and should be read in conjunction with the Platform’s Terms of Use. By viewing and using this Platform you will be deemed to agree to this Privacy Policy. If you do not agree to this Privacy Policy, please stop using the Platform, and contact us (see section “Contact” below) so we can discuss your concerns.

 

All capitalised terms that are used but not defined in this Privacy Policy will have the meaning given to them in the Terms of Use.

 

 

1.             Collection of Information

1.1      We may gather two types of information about you from the Platform:

 

(a)    personal information provided by you, which includes, but is not limited to, your name and email address. You may supply us with additional personal information such as your organisational or Institutional affiliation, job title, phone number, address (for example but not limited to requesting us to provide you with support). Such additional personal details are not required for use of the Platform. If you have purchased a subscription to OB3 you may provide us with financial and credit-card information. Examples of other types of personal information you may voluntarily give to us (for example during support or training interactions with us) include personal description and personal circumstances. For clarity: please note that content that you create or upload to the Platform is not regarded as personal information (see below: User content).

(b)   aggregate technical information automatically generated by our systems, which track traffic to the Platform, which includes, but is not limited to, the IP address used to connect your computer to the Internet, operating systems and platforms, your web browser type and version, pages you viewed or searched for within OB3, page response times, download errors, length of visits on certain pages, page interaction information, and any other such technical information relating to your use of the Platform.

1.2      Failure to provide necessary personal information when requested may result in certain services on the Platform not being available to you. For clarity this specifically includes failure to provide correct name and email information, or attempting to access OB3 using a web browser or operating system which is not supported.

 

1.3       If you invite a new user to the Platform by sharing content with them, you will ensure that person has consented to us contacting them for the purposes of facilitating account invitation to them.

 

1.4      If you submit a signup request for an OB3 account on www.ob3.io then you consent to us storing your personal information for purposes of providing you with an account.

 

1.5      Your name and email address will be transferred to the Platform (to facilitate automatic creation of an account on the Platform) when you follow an LTI link from your Provider’s learning management system. We will show an in-platform message, and email you an introductory message containing links to this Privacy Policy. Your continued use of the Platform will be deemed as constituting acceptance of this Privacy Policy.

 

1.6      If you access a service or application that is delivered using the Platform, such as the Virtual Ophthalmic Studio application, then you must also accept the privacy policy for such applications (if any). Such applications or services will be delivered on sub-domains of the platform’s domain “ob3.io”.

 

1.7      If you do not consent to your personal information being used by us for purposes of providing you with access to the Platform, then you cannot use the Platform. If you have an account you can revoke consent for us to use your personal information, by requesting us to close your account and delete your personal information. To do this please send a request to the Privacy Officer (see below section 9: Contact)

 

1.8      We may continue to securely store your personal information within Platform backups and logging, and within a secure record-keeping of Platform users who have requested their details be deleted. Backups and logging information are retained for Platform integrity, security, and other legitimate needs related to providing the Platform service. In the event of any backup or logging information being restored for use, your personal details will be deleted from the restored information.

 

2.             Disclosure of Information

 

2.1      We will not disclose your personal information to any third party unless you have given us permission to do so, in this Privacy Policy or otherwise.

 

2.2      If you are a Learner, we may disclose your personal information to your related Provider and/or Facilitator (whichever are applicable to you) to allow them to review your use of the Platform, monitor your progress, and/or if we believe that such disclosure is necessary to ensure your safe and proper use of the Platform.

 

2.3      We may disclose to third parties:

 

(a)    any information that we gather about you for the purposes of providing the Platform to you;

(b)   aggregate tracking information and other information that does not personally identify you;

(c)    your personal information when we believe in good faith that we are required to do so by law; and

(d)   your personal information, provided we have your prior authorisation, which we will obtain at the time of collecting the information from you.

 

3.             Use of Information

 

3.1   Generally, we will process and use the information we collect:

 

(a)       to verify your identity and assist you if you forget your password or login details for the Platform;

(b)       for purposes of securing the Platform;

(c)       to assist in providing the Platform and its services to you;

(d)       to ensure you are using the Platform safely and for its intended purpose;

(e)       for ensuring that you are shown the information that is most relevant to you and your interests; and

(f)        for any other use that you authorise.

3.2   If you are a Learner, we may (in addition to clause 3.1) process and use the information we collect to help you, your Provider and/or Facilitator to:

 

(a)       assist you in meeting your Course requirements;

(b)       record and maintain records of Course progress;

(c)       record and maintain records of Course Content or your User Generated Content;

(d)       provide advice or reports to your Provider and/or Facilitator to assist them in delivering their Course to you;

(e)       celebrate/record achievements and success in learning;

(f)        enable integrated use of the Platform when used in conjunction with a Provider’s Learning Management System (LMS); and

(g)       provide you with alumni access to Course Content.

3.3   If you have submitted your personal information to us, or have consented to your personal information to be submitted to us, through the Platform, the enquiry form, Intercom, email, survey forms, as part of a free account registration request, or signup request for a webinar or similar events, then we may use your personal information for the purposes of managing our relationships with you, communicating with you, keeping records of those communications and promoting our products and services to you.

 

3.4   We have the ability to access your account for certain purposes, these include providing support to you (where you request it), investigating a complaint, and ensuring compliance with this Privacy Policy. This privileged access is restricted to authorized staff at OceanBrowser, and such access to user accounts is logged. If you do not want OceanBrowser support to access your account under any circumstances please email the Privacy Officer and you will be added to the support access opt-out list.

 

4.             Cookies and Tracking

4.1   We may use a "cookie" file containing information that can identify the computer you are working from. The cookie file will not be connected to your name and only gives us details of your IP address, the platform you are using, browser (e.g. Google Chrome, Safari, Microsoft Edge or other, plus the version of browser) and domain (whether you are accessing the Platform from New Zealand or elsewhere).

 

4.2   We may use the information generated by cookies to:

 

(a)       track traffic patterns to and from the Platform;

(b)       ensure any content is being shown to the most appropriate person; and

(c)       enable you to enter the Platform and use certain services as a member without having to log on each time and to visit registered user only areas of the Platform.

4.3   You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive or other storage device. Refusing the OB3 cookie may result in you being unable to access the Platform. You can contact us for specific advice on how to enable the OB3 cookie while disabling other 3rd party cookies.

 

4.4   A Provider may choose to export embedded references to resources hosted within the Platform for the purpose of embedding resources within that Provider’s LMS system. The terms of this Privacy Policy will still apply to use of embedded OB3 resources within the LMS system.

 

5.             Content Providers, Advertisers and Partners

5.1   We do not control the practices of content providers and partners connected with the Platform and to whom you provide personal information whilst using one of the Platform or services. The Platform may contain links to other sites, which may not follow the same privacy policies as us. We recommend that you check any relevant privacy policies before providing your personal information to any third party.

 

5.2   When you embed content in any User Content by pasting URLs sourced from a 3rd party provider within the Platform, the content is being delivered by that provider. Viewing embedded content is covered by the terms of use and privacy policies of the 3rd party provider, which may include setting a cookie on your device. If you wish to avoid 3rd party cookies, privacy and terms of use requirements, you may instead choose to upload your content (for example, a video) directly to the Platform.

 

 

6.             Opting in and Opting Out

If our intended collection, use or disclosure of your personal information is outside the collection, use or disclosure set out in this Privacy Policy we will give you the option to:

 

(a)       opt out and not receive certain services or participate in certain interactive areas; or

(b)       opt in to agree to be contacted by us in relation to certain matters such as notification of new features to the Platform.

 

7.             Changes

Any changes we make to our privacy policy in the future will be posted to https://www.ob3.io/privacy. For Users who have been active in the Platform in the last 30 days we may additionally send notification via email to those Users summarising what has changed and a reminder of how to access the Privacy Policy.

 

8.             Holding, Correcting and Updating

Any personal information that you provide to us is collected and currently held by us at our nominated secure data centers in Australia, UK and Singapore that we use to provide the Platform and its services.

 

If you are an individual, under the Privacy Act 2020, you have the right to access, correct or change the information we hold about you. We will use our best efforts to provide prompt assistance to you to access, correct or change this information where you require support from us to do so.
